As the turf war between Aam Aadmi Party government and the office of Lt governor of Delhi entered its third week, speculations are ripe that Arvind Kejriwal-led regime is planning to raise the demand of full statehood for the National Capital in the coming week.

Completing his 100 days in office on Sunday, the chief minister of Delhi held a meeting with all his legislators at his residence to discuss notification backing the L-G's authority to appoint bureaucrats. The Centre had also stated that the anti-corruption branch of Delhi government had no powers to take action against central officials, including categories like IAS, IPS, DANICS and DANIPS.

I do not think AAP will provide an efficient and honest government in Delhi. Kejriwal, much like Modi, can only create image by speeches but when it comes to action, both are equally autocratic/dictatorial. If another election becomes necessary in Delhi in the next one or two years AAP is likely to shrink back to its six seats and then, as time passes, it will most probably be a forgotten party like the Rashtriya Samajwadi Congress, does anyone remember!

New Delhi: In the midst of his bitter tussle with the Lt Governor, Chief Minister Arvind Kejriwal on Monday resolved to take back Delhi government's powers from the Centre within the current term and said the city can be granted full-statehood within 10 days, if Prime Minister Narendra Modi wants.

In an address at an "open cabinet" to mark 100 days of AAP government, Kejriwal said the Centre's notification giving absolute powers to the Lt Governor reflected its "dictatorial attitude" and accused the BJP-led government of taking revenge against people of the city for handing the party a crushing defeat in the assembly polls.

"The fight to liberate us is on alongside work. This fight will continue and I hope that in the next five years, we will get back the powers that the Centre has taken from Delhi," he said.

Presenting a report card of his government, he said no other government in the country has ever achieved so much in the first 100 days. All the ministers also presented their achievements and interacted with the people.

"We don't want to fight with the Centre. We want to work together. The first thing we did after winning was to meet Prime Minister Modi. We told him you have full majority in the Parliament and we have the same in the Assembly. This is a golden opportunity bestowed by God upon us. If PM and we converge then I think Delhi would get full statehood in 10 days," Kejriwal said.

Referring to the notification issued by the Home Ministry, he said, "Issuing such notification amounts to dictatorship and the public will avenge such decisions."

"We never thought they would get down to take revenge against the people of Delhi in this fashion. I think we should accept people's verdict and work together," he said.

Among the officials who were present in the event included Shakuntala Gamlin, the IAS officer whose appointment as acting Chief Secretary by Lt Governor Najeeb Jung had triggered a full-blown war between him and Kejriwal.

I am not the fan of AAP, but Lt. Governor is creating issues to Kejriwal government which should be allowed to rule as they want unless go out of constitution or law and order issue. It was given big mandate by people. Lt. Governor or proxy fight from BJP is disgusting, anti-democracy and people are not going to like it.
 
Mr Najeeb Jung, present Lt. Governor of Delhi is not a politician, he is a seasoned bureaucrat who goes by rule book. He is an alumini of London School of Economics and holds MA in Economics and had an impeccable career throughout his tenure with the Government and outside. "Mr Najeeb Jung's family features a long line of forefathers who have held positions of great power in their time. His grandparents have served as the chief justice and chief engineer in the court of the last Nizam of Hyderabad. A great grandfather was one of the co-founders of the Aligarh Muslim University." He had held the post of Vice-Chancellor of Jamia Millia Islamia before his appointment of Lt. Governor of Delhi.
Though Mr Jung is an appointee of previous Congress Government, the present Government under Mr.Modi continued his services in recognition of his professional acumen.

Confrontation between constitutional authorities is not new in our Country. Here is an excerpt from an article on the subject published in Desh Gujarat.

" In Gujarat, Governor Smt. Kamla Beniwal, a veteran ex-Congress politician from Rajasthan, is known for creating hurdles after hurdles for the State Government. Governor is sitting on a number of legislative proposals passed by the Gujarat Legislative Assembly but on one pretext or the other, she is not giving her assent and has become a stumbling block in the development of the State, which is considered a model State. She has blocked a number of progressive bills initiated by the State Government. In fact, by her action, instead of State Government leaning on her for wisdom, trust her to create obstacles in the development of the State. The Governor House in Gandhinagar has become the place for intrigue and conspiracy against the duly elected State Government. It reminds of the era especially of 1980’s when Governors in various States at the behest of the Central Government were plotting against their non-Congress Governments in various states viz. Andhra Pradesh (against late Sh. N. T. Rama Rao), Karnataka (against late Sh. R. K. Hegde) and Jammu & Kashmir (against Farooq Abdullah) headed by opposition stalwarts."

There are many gray areas in our Constitution which can be decided case by case only by Highest Court in the Country.

some kind of problem happened in pondicherry also ....some years back....these UTs are neither full statehood now fully UT...

goa was previously UT...now full fledge state....
 
Excerpt from article published in The Hindu under caption ‘Governors and guidelines’, by P.S. Ramamohana Rao, who was a Governor of Tamil Nadu between 2002 and 2004:

“The misuse of the office of the Governor for political purposes started as early as in 1952, when the Governor of Madras took it upon himself the task of frustrating the prospect of a government dominated by the Communist Party of India. He persuaded the Prime Minister to agree to his proposal of nominating the would-be Chief Minister to the Legislative Council and proceeded accordingly to install a Congress government in office. Then came 1957, when the Communist government in Kerala was deposed by invoking Article 356 (President’s Rule). Such misuse of office was subsequently compounded in growing measure, by abuse of power by errant Governors, thus bringing the office into contempt and public ridicule.

In the absence of clearly laid down criteria for selection, the process of appointment of Governors has been from the beginning, political, and rightly so, because of the political nature of the office. The quest is not for the best person available for the post. The test is whether the person chosen has a public record that is without blemish and above reproach. Necessarily, he or she has to be one known to the powers who are responsible for the choice, and acceptable to them, as also the State government which is in office in the particular State.

The recent Supreme Court verdict on the appointment of Governors does not impose any restrictions on the government’s choice of Governors. It only cautions that the pleasure of the President cannot be withdrawn on grounds of political incompatibility or any arbitrary grounds. It does not provide any pre-emptive relief, but only asserts the jurisdiction of the court to look into the matter post-facto if the aggrieved were to approach the court. “

It is my view that giving Statehood to Delhi is not a right step. In a federal setup the national Capital should be governed directly by Central Government. Mr Shankkar Aiyar, well known Economic and Political Analyst in his write-up argues this point in "The New Indian Express" under the caption "Why Does Good Governance Need Delhi to be a State?" ends up with the words "Why not dump the idea of Delhi as a state and revert to the idea of keeping the national capital as the national capital?" I agree with his view.

Big relief for Centre, High Court rules Lieutenant Governor the constitutional authority in Delhi

New Delhi: In a big relief for the Central government, the High Court said the Lieutenant Governor is the constitutional authority in Delhi. Both the Centre and the Delhi government have approached the court following power tussle over the appointment of bureaucrats as Chief Minister Arvind Kejriwal and Lt Governor Najeeb Jung were locked in a bitter fight on the issue.

The high court said that Lt Governor will deliberate on proposal given by the Delhi government The court has declined the request of petitioner to change the Constitutional primacy of the Lt Governor. Meanwhile, a notice has been given to the Centre on Delhi government's plea
