With India emerging as a top destination for multinational companies and corporate disputes on the rise, foreign law firms requested the Supreme Court on Monday that they should be allowed to operate in the country.
Appearing before a bench of Justices A R Dave and Kurian Joseph, some international law firms pleaded that restriction on their entry should be done away with and they should be allowed to practice in India.
Senior advocate Abhishek Manu Singhvi, appearing for two American law firms, told the bench that baring global law firms served no purpose in the era of globalization when there was no such restriction on MNCs to enter the domestic market.
He said Indian lawyers were allowed to practice in other countries and there was no rationale to keep foreign law firms out of the country.
"In this era of globalization, when all big investments are being made in the country by foreign companies, there seems to be no reason why law firms should not be allowed," he said.
A registered society of advocates, Global Indian Lawyers, said restricting foreign firms from opening their offices in India was wrong. It challenged a Bombay High Court verdict of 2009 quashing the Reserve Bank of India's decision allowing some foreign law firms to open liaison offices in the country.
