Delhi high court upholds death penalty for 4 convicts in December 16 gang-rape case -Hindustan Times


The Delhi High Court on Thursday upheld the death sentence awarded to the four convicts in the brutal gang rape and murder of a 23-year-old woman on December 16, 2012, which triggered countrywide outrage.


A bench of justices Reva Khetrapal and Pratibha Rani confirmed the sentence of Mukesh Singh, 26, Akshay Thakur, 28, Pawan Gupta, 19, and Vinay Sharma, 20, saying their crime falls in the rarest-of-the rare category, which warrants death penalty.


"Death reference is accepted. Death sentence awarded by the trial court is affirmed. The appeals of the convicts are dismissed," the bench said.

"On August 31, another accused, a juvenile, was convicted and sentenced to a maximum of three years in a reformation home" - This is the juvenile that did the most damage in terms of violence and must have been tried as an adult. Getting out in three years while others are given death sentence does not make sense to me. I know that juvenile is a Muslim but hiding such details does not lend credibility to the whole proceedings

They all should have all gotten life in prison which may have been better justice ...There is no need to kill them all though it is possible to understand the rage people feel towards them

It is the law that protects them. Recently, the Supreme Court of India ruled that the juvenile age limit should remain 18 years. Why not our Parliament enact a law awarding punishment depending upon the seriousness of the crime irrespective of age, I mean above 15 years, bcos with more exposure to TV, ‘A’ movies, internet sites, magazines, etc, the youngsters below the age group of 18 are well informed of things when compared to earlier generation not to speak about western influence.


The Juvenile Protection Act is an age old law requiring immediate revision IMO.

Even our constitution was amended more than 95 times. While so why not these laws.............????

Good point indeed .. Actually if the possibility of being tried as an adult is available on a case by case basis certain kind of crimes by adults enrolling youngsters will not happen easily. In this instance the juvenile is a full fledged criminal and this message has to reach all such people and their parents
 
can be amended when this juvenile is taken up as a special case and tried again in the court, there are probably more important backlogs to be cleared than doing this.
 
I do not know if death sentence or juvenile law revisions are solution to the basic issue of women safety.Rapes and molesting have not stopped . only more get reported.one of the major reason is sudden exposure of people from urban villages in delhi to bold educated working women .the urban ghettos breed criminals due to exposure to porn movies and the like. there is also a domestic angle .many children are victims of molesting when working women leave them with servants and immoral relatives. also thereis a tendency to cover up molesting if it happens to be a relative for family honour. there was a film 'highway' on this subject. a pretty film.
 
i do not know the specific IPC gee-y-zee-00? either. just trying to understand if there was any new law amended to the existing law on this matter (the news headline says UPHOLD)...

In this case, the trial court awarded Death sentence and the High Court affirmed it dismissing the appeal petition of the convicts.
