Eminent Jurist, Justice VR Krishna Iyer passes away in Kochi.



Kochi December 04, 2014: Former Supreme Court judge VR Krishna Iyer (100) passed away on Thursday at the age of 100 in a private hospital in Kochi, Kerala. Iyer was suffering from some kideny related problems and was admitted in the hospital on November 24. He expired today at 3:30 pm.

Rashtriya Swayamsevak Sangh expressed deep condolences on the demise of an eminent jurist. VR Krishna Iyer was one among them who appreciated RSS, its ideology and activities.

Vaidyanathapura Rama Krishna Iyer, popularly known as Justice V. R. Krishna Iyer, is a former judge in the Supreme Court of India. He was born at Vaidyanathapuram near Palakkad, in Malabar region of Kerala, but grew up at Koyilandy, also in the erstwhile Malabar district. In 1952, he was elected to the Kerala Legislative Assembly; in 1957, he became a minister in the first Communist government in Kerala, serving until 1959. Having been the minister of law, power, prisons, irrigation and social welfare in the Government of Kerala, he was instrumental in bringing about many significant changes in these sectors. In 1973, he was sworn in as a Judge of the Supreme Court of India; as of 2011, he is the last Supreme Court judge to have previously served as a politician. He was conferred with Padma Vibhushan in the year 1999.

Man who rescued Supreme Court from supreme shame

He defined fundamental rights as well as charters of freedom, not just to acquire and hold wealth, but freedom from poverty and misery . He ensured that the hesitation in reading due process into Article 21 was dispelled. The foundation for a whole jurisprudence was laid by reading Article 14 as a charter against nonarbitrariness.

By refusing an outright stay on the verdict setting aside Indira Gandhi's election, he showed that however high and mighty you are, the rules of the game do not change. The bar for future judges was set very high! This was what may be called the Krishnaiyerisation of Indian jurisprudence.

He rescued the Supreme Court from the supreme shame of the Shivkant Shukla judgment (in 1976, Justices P N Bhagwati, A N Ray ,YV Chandrachud and M H Beg agreed with the then Indira Gandhi government that even the right to life stood abrogated during the Emergency in ADM Jabalpur vs Shivkant Shukla case).

The verdict constitutes one of the darkest chapters in the history of the court as it struck at the very heart of fundamental rights. It was a judgment that put a question mark on the credibility of the institution. If detention even on a mistaken identity was not amenable habeas corpus, and a detenu lacked the locus to question his own detention, then we could as well wind up the Supreme Court -and the high courts as well. Post Emergency , the Krishna Iyer jurisprudence breathed new , life into what was seen as a listless institution. Supreme Court today stands tall and is ! the most powerful institution of its kind in the world and its work has shown that it is sui generis. India needs such a court even if other countries do not have or need such a court. That other similar institutions do not do what our court does did not deter Krishna Iyer from redesigning constitutional remedies to address constitutional aberrations.

i think VRK was unanimously hated by all the land owning pattars of kerala of those times. and also the Catholic Church, whose powers he took away with his education reforms -the Church which ran majority of the schools in Kerala, used to pay pittance to the teachers, most of whom were xtians, and receive blank receipts from them. VRK ensured that all teachers are paid by the State and would get a decent wage, and the schools were made free to all. one of the reasons, why Nehru, 'dismissed' the EMS government as 'anti national' :)

in kerala ...pattars were never happy with EMS and VRK..........even though ...both are brahmins...both were hatted so much....

yes, for all his communism beliefs, the man was cremated saakshaad brahmin style, with all the ceremonies intact. compare that with EMS who had an agnostic cremation,with none of the rituals. who was more honest? .. is a question that we can all ask? eh!
 
he carried the surname iyer till the end. we do not know whether he left any will or instructions how his antim samskaras is to be done. his two sons with iyer surnames did what ought to be done, perhaps as per his wishes. there is nothing to show that he relinquished his native religion. one does not become anti hindu automatically because he fights social issues.
