I am with you on this issue.
As I opined in the other Thread in Community and Politics: 2G issues...., this SC verdict is a watershed moment in India's Business World, where politics, media, judiciary coalesce to thrive.
Corruption is endemic in India, as you mentioned before. In all we have low Integrity and Professionalism among people of all sorts in India: I have listened to people who have argued "What's wrong with giving and taking bribe, anyway? That's just cost of doing business in India!" etc. We have a deep rooted cultural problem, I dare say.
Dear N and myself (we both belong to birds of same flock on very many social, religious issues) don't agree on the 2G scandal and this verdict!! Lol
Here are my core observations on this SC verdict -
1. Unfortunately, this case was adjudicated by a 2-person Bench. This is such a very important case this deserves a Full Bench of 9-11 Justices.
Is there an Appeal Process here to address the grievances of the injured? Probably, not.
2. Can the Apex Court interfere in the Policy Decisions of an Elected Govt (be it NDA or UPA Govt)? Is this not a Hyper Activism of the Judiciary (to borrow the phrase of Robert Borg in the US)?
3. Which method is useful to the Society: FCFS allocation of the 2G Vs Allocation to the Highest bidder? If the supply side cost for the mobile service goes up materially (which I expect), will this be a concern of the Apex Court?
4. The SC invokes the "Doctrine of Equality" of the Applicants for the 2G licenses. Where is such doctrine for the Consumers?
and so on.
I am very unhappy that politics has entered into SC: they are bent upon messing up the Elected Govt.
Mrs. Sonia Gandhi and Dr. MMS did not handle this issue well from the beginning, I dare say.
