India tears into Bharara for defending action against diplomat - The Hindu

In a statement in the U.S, the India-born Bharara not only defended the action against Khobragade but also said that maid Sangeeta Richard’s family has been brought to the U.S. He said a legal process was started in India to “silence her and attempts were made to compel her to return to India“.


The statement of Bharara questions the legal system of India and in fat Indias sovereignty.


I do not think Bharara would dare to do this even with other states in the U.S. There is a proper procedure even for that.


He is talking as if he has rescued people from there prisons of Columbia.


Are we going to put up with this insult to the nation?
 
I heard Sir Meghnad Desai saying that Khobragade had lied on oath w.r.t. the visa application of the maid. He made one more charge against her. Anyway we don't have to worry because this Khobragade is a privileged citizen in India (SC/ST) and so GOI will leave "no stone unturned" to get her out of all the difficulties. Possibly she will be made our envoy to Brazil/Venezuela or some other country not close to US
 
Relation between countries is governed by hard headed calculations and not by emotions. We Indians tend to become emotional with any thing too early. With China it was Hindi Chini bhai bhai and the Panchsheel. Instead of using the slogan and the panchsheel to make China commit itself to a certain political line despite its decision making monolithic oligarchy's penchant for revolution every where, we lived the slogans emotionally and were finally made the suckers. We can take anything in our conduct, we are emotional and so make a fool of ourselves. If it is caste we will keep on flagellating for centuries and will never learn to put things behind and move ahead with time. Now another episode of this continuing courting of tomfoolery is going on in the Khobargade case too. We need to think about the following questions:

1. If a senior diplomat needs a domestic help what prevents the Govt . of India from providing such helps treating them too as Indian Government employees. Their pay and other benefits will get fixed in a time scale as other employees of our missions.

2. The moment khobargade's maid went missing in US why her relatives in India were not put under surveillance by our agencies. Or did they do it and allowed them to go so that they can use this fact against US.

3. If we have been extending more privileges to US diplomats in our country than what our diplomats are allowed in US we should withdraw all of them and stick to a strict reciprocation in such matters. But what is the need to make a big splash of the withdrawal of these additional privileges extended to the white sahibs? Who are we trying to address and impress? A possible vote bank? If that is the case as it appears to be, then it is a dangerous game we are playing. It would be better to stop it forthwith. Even if it results in certain privileges remaining in place without a reciprocation let it be. This is not the way to withdraw them.


4. India should make a demand on US to return the citizens (the family members of Richard included) to India so that they can stand trial here in the court of justice where a case is pending.

5. India should share with its citizens here all the info that is there in its possession about this case so that people can make an informed opinion on the developments.

I am happy that India ha asked for U.S to drop the entire charge and apologize.

We have survived without U.S in the past. It is U.S who armed Pakistan. Almost all out soldiers dies form U.S bullets. U.S almost invade us at the time of Bangla Desh War They still continue to arm Pakistan.

For long these Americans and other varieties of firangs have taken us for granted, and we loved to surrender every time they insulted us, interfered in our affairs and humiliated our citizens. The way they treated our former president, cabinet ministers, students hasn’t been forgotten by Indians. Our ministers are subjected to humiliating searches and we kept quiet. They brazenly snooped on our highest state leaders, violated security norms, abused friendship and still this government didn’t utter a single word in protest. German Chancellor Markel cancelled her US visit on NSA snooping. Israel protested. French President hit back at US. It was only Indian government that in a way justified US snooping on us.

We may have the rights of both the Indians protected, of Devyani's and as well as Sangeeta Richard's. But should we accept the most unacceptable undiplomatic behaviour of the US? That's the issue.

Devyani richly deserves her fate. She is a serial criminal who is sponsoring an illegal immigration racket. Her maid is now missing. Devyani is actively involved in the Adarsh and other scams.

Add to it, the government is fishing for Dalit votes as she is a Dalit. There's more to this case than what's shown in the media. If she's arrested, many criminals in the foreign service will meet similar fates.
 
Devyani may have broken US laws, but should have been accorded Diplomatic curtsy. US could have asked India to withdraw her at best. Preet Barrera is desi, and NRI must remember that when he comes asking for money from desi's.


If diplomatic staff have to be accorded US wages, no one can afford it. What about the diplomatic staff of Jamica, Zambia or Gambia do they get US salary? This was overreaching on the part of US. That too for the maid with connection into US consulate in Delhi.
The maid had strong contact, and her blackmail failed. Us did not comply with Indian court order for Indian Citizen, there must be consequence.

I was only saying that since she belongs to the privileged class, the GOI will surely do everything it can to help her out.

But as regards the case, arrest, etc., of Khobragade I understood from TV discussions as if she (Khobra) had not maintained a smooth relationship with her maid and the latter could, therefore, be easily brainwashed by Bharara and the human rights outfits linked to him. Plus Khobra filed a case in Delhi against the maid which made the situation worse.

It looks this is not the first time such cases are brought up against Indian diplomats and this is one of the staples for the so-called human rights lobby in the US. Khobra, as a diplomat, must have learned the pitfalls in her posting and lived accordingly, instead of precipitating such a confounded crisis.
 
Uttam Khobragade on Thursday alleged a conspiracy behind the arrest of his diplomat daughter Devyani in New York and said all charges against her were fabricated as he dubbed US Attorney Preet Bharara's remarks after the incident as a "blatant" attack on the Indian judiciary.
"Please take cognisance of Bharara's utterance, that the Indian legal process is meant to 'silence' the maid," Khobragade, a former IAS officer, told reporters here.
"It is a blatant attack on the judiciary of India," he said. "Is it the Prime Minister or is it Preet Bharara who rules India?' he asked.
Khobragade accused the maid of fraud and said all charges must be dropped against Devyani.
"Devyani has been falsely implicated. The entire case is a conspiracy. The FIR against her was fabricated. The US must withdraw charges against my daughter," he demanded.
"I wish to thank the government and media for their role in handling of the case," the father said.
Raising further objections on Bharara's remarks, the father said, "What does his statement say? It says that the Indian courts were trying to silence the witness. That means Indian courts are not here to give justice but to silence the victim. Is it not a serious criminal contempt of court." "I want to make an appeal to the Supreme Court. Please take cognisance of this utterance, which is nothing but scandalising the process of justice in India," he said.

This young woman was probably doing whatever all the other diplomatic staff were doing, but got into trouble because the maid seems to have had other ideas. The Indian mission in the U.S. should have established policies and procedures for the staff to follow so that they won't get into trouble. They failed in their duty.

Law breaking is not the only issue here. Diplomatic protocol is just as important. Proper channel must have been observed. She could have been held separately, in which case body cavity search could have been exempted.

This is a stupid thing to do from the U.S. perspective as well, what if a female American diplomat is picked up in Russia based on some accusation and is treated in this way, would the U.S. keep quiet saying she broke the law?

This kind of behavior feeds into the already existing narrative of arrogant Americans. This is why there is so much understandable outrage. Now the world is watching how India will act. Would India make some noise and go back to the usual status quo ante, or would they have the guts to stand up to the Americans and extract an apology and parity?

Indians always want to compare themselves to the Chinese, how would China have dealt with a similar situation? America needs India just as much as India needs America. America is not India's friend, and India shouldn't try to aspire to be one.

p.s. it is abhorrent to bring her caste, whether it is by Mayawati or Sangom .......
 
It is not about Dr. Khobragade at all. It is about Indian diplomat and US law enforcement, particularly Mr. Barrera.

Observing that the statement underlines the compulsion that is felt by the Manhattan US Attorney’s office “to make sure that victims, witnesses and their families are safe and secure while cases are pending,” MEA said, “This is precisely why, when there is a prior legal process already underway in India, the Manhattan US Attorney should consider it obligatory to enable justice to take its course in India in the first instance.


“When the legal process in another friendly and democratic country is interfered with in this manner, it not only amounts to interference but also raises the serious concern of calling into question the very legal system of that country.


“It is our considered view that this statement is one more attempt at a post facto rationalization for an action that should never have taken place in the first instance.”

The rich and powerful always get away, at an individual level as in Sankararaman case, or at international level when Americans are involved.

It's a moot question whether the US would have cast aside the Vienna Convention on Consular Relations - which forbids arrest of consular officials except for grave crimes (let alone subjecting them to felon-like treatment) - so blithely if a Chinese or Brazilian rather than Indian diplomat had been involved. So what is it that differentiates China or Brazil from India? One, it's well known they are no pushovers and will retaliate measure for measure. And two, they are perceived as growing economies in which the West has a stake, and therefore worth listening to.



Contrast the casualness with which western institutions treat India. Much western newspaper coverage of the Devyani affair, for example, is replete with patronising generalisations about Indian society, reflecting the disdain of a high-wage economy for a low-wage society. As a result there is little reflection on the ludicrousness of the charge against Devyani, who is accused of paying below minimum wages because she didn't pay $4,500 a month to her maid. Since that amount exceeds average US per capita income, on that count most Americans are criminally exploited and their employers ought to be charged as felons!
 

I've lived in the PRC, Taiwan, and Japan, among other places. Even Nigeria and Ghana have booming economies.. also see Rwanda now. US will respect India only when Indians respect India. The fact that Devyani is a Dalit and the gov't is bending backwards to help her is only defocusing attention from her misdeeds. And the fact that criminals like Azam Khan are suddenly supporting her only reinforces the perception of India as a corrupt, 4th world backwater.

The US won't play around with rich countries, or countries which are getting rich. We are not Indians, we are Brahmins, Backwards, SC/STs, Muslims, and so on. Indian identity is the last and least priority. This will never allow India to be rich, ever.

And Indians in America who condemn the US' actions while earning their bread in the US are not even worthy of contempt, it exposes their hypocrisy and double standards. This forum is filled with many good people who throw stones from their glass cubicles or ivory towers.
 
The fact that the U.S. and other countries do not show respect for India should make us introspect. There is no point in blaming others for our inadequacy though I agree we need to react to the situation. But I am sure it may not elicit the desired response. The substance of India at present is not as bad as its image but I am optimistic because the strongest point is the potential. To turn it into reality we need politicians at the helm who realize this and are sincere in their attempts. We do not need the honesty and earnestness of a Gandhi but even a fraction of that can do wonders for India.

Indian Consul is himself paid less than the minimum wages prescribed for domestic help in the US! The servant maids taken by Indian consulate officials are therefore, discreetly, permitted to work for others (mostly PIOs) and earn something more than what the consul officials agree in writing to pay. The servants are thus kept satisfied that they are earning something more and can repatriate their savings back home. Devyani Khobragade did not allow her maid to work anywhere else (and earn a few more $) and, besides, DK's behaviour towards her maid was reportedly, too authoritarian since she is the daughter of an IAS officer and all along she had been accustomed to such behaviour in her life.

Naturally, the servant would have complained to her friends among the consulate servants and the news would have travelled fast and strong. Preet Bharara somehow took up the case on the basis of some complaint made to the US government department.

There were 3 similar cases in the past 2 years in the NY consulate itself but none of them escalated. This is as per CNN-IBN. One former diplomat also supported this. We are seeing such high drama in DK's case because the UPA govt. just cannot afford to be seen as inactive in a pre-election year for a SC/ST case and this is a very vital ingredient in Indian politics, notwithstanding your abhorrence.
