JJ gets interim bail

AIADMK chief Jayalalithaa, who was sentenced to four years’ simple imprisonment and imposed a Rs. 100-crore fine for her offences under the Prevention of Corruption Act, was granted interim bail by Supreme Court on Friday.

The Supreme Court has told Jaya's lawyers that the bail plea of 35,000 pages has to be filed and presented to the court by December 18. If this does not happen Jayalalithaa's bail plea remains cancelled. Her sentence remains suspended till December 18. The court has also ordered Jaya to remain housebound.

Jaya has also been ordered by the court to tell her party members to behave like 'civilized citizens' and if they don't, the bail will be cancelled.

It is really a mockery of justice there was no different ground for granting bail than when it was rejected by karnataka high court
 
The similarity is that Fali Nariman was successful in getting bail for JJ, as was in the case of Acharyas.
 
There are prisoners who are languishing in jail for years for misappropriating funds in thousands. but someone who has committed similar crime but to the tune of millions is granted bail. this is the irony, paradox or whatever you call of our indian judiciary. perhaps hence the symbolic angel of justice is blind.

As soon as news of Jayalalithaa’s bail reached them, jubilant All India Anna Dravida Munnetra Kazhagam cadre gathered outside the Parappana Agrahara, Central prison complex on Friday. They were desperate to catch a glimpse of their general secretary by evening, but were in for yet another disappointment as the formalities for her release could not be completed in time.

Deputy Inspector General of Police (Prisons) P.M. Jayasimha said: “Ms. Jayalalithaa could not be released from prison on Friday since we did not get the court orders in time. Her release is an eventuality on Saturday.”


He added that he met her on Friday after she was granted bail. “She was calm and her health is also fine,” he said.


There were prohibitory orders around the prison and arrangements were made at HAL Airport where a special chartered flight was ready to fly Jayalalithaa to Chennai.

It required Fali Nariman to find a loophole for bail in supreme court.He could differentiate between stay of conviction and suspension of sentence to get her bail.

we have very few good lawyers in india.

common people can neither find them or afford them.

judiciary is painfully slow. supreme court going on vacation from next week and high court taikng its time to do the formalities of release leading to further delays does

not send positive signals to public . if t takes twenty days for a person with mighty resources to get bail pending appeal what kind of message does it send to ordinary

people .

it has taken 18 years to bring a person to justice in a junior court.

I am not optimistic about the future either,

someone in the chain of highr courts will find more loop holes in the evidence presented to get her out .

only it might take a brilliant lawyer and more money spent
 
My contention is not Ms. Jayalalitha to languish prison for ever but when argued on the same ground she was not granted bail now has been granted bail..this irony only i'm saying is mockery of justice
 

The way in which JJ gets bail from Supreme Court, JJ may not find much difficulty in getting acquittal from the case by middle of 2015 or at the most end of 2015.

I tend to agree because as 'Cho' pointed out the incometax-tribunal awards and tax assements have NOT been taken into cosideration by trial court.. Moreover the silver&gold have not been assessed as per the guidelines.. One Mr. Basker who did the valuation has become 'Untraceble'..as per records..!! If at all she gets problem it may be due to the KodaNadu Estate.. The latest salvo by Nariman in SC that the case itself do not fall under the purview of 'prevention of corruption act' will become another point favouring JJ..
