Indictment of Retired Judge of SC

I am very much disturbed by the news that the panel of Judges appointed by the CJI of Supreme court to enquire into the complaint of an incident involving Retired SC Judge alleged by an intern has indicted the retired judge for sexual harassment of a former law intern in December 2012. However since no details are available on the alleged incident we cannot comment further.

Our Constitution has kept the members of Judiciary above the scrutiny of even elected body, for the simple reason they should be allowed to do their job without fear or favour. Judiciary is the last resort of redress for the common man of this nation. Judges should be protected from frivolous accusations. Otherwise any aggrieved party may resort to file all sorts of complaint against the Judges.

The CJI called for a full court meeting of 30 judges on Thursday evening to deliberate upon the committee's report. At the end of the hour-long meeting it was decided that no further follow-up action was required as the Judge involved in the alleged incident had already demitted office on the date of the incident.

A statement on the SC website said: "As decided by the Full Court in its meeting, it is made clear that the representations made against former judges of this court are not entertainable by the administration of the Supreme Court."
It is a good decision by the SC.

The problem is that the public does not know what were the "verbal/non-verbal conduct of sexual nature". Neither the complainant woman nor the panel report is available to us. Hence, the only moral to be learned from this is, if you are a judge or lawyer, don't accept any female intern.

Having said that, to me, it appears why the services of that female intern were so urgently required at night especially when the Supreme Court Committee has said that "the said intern was not an intern on the roll of the Supreme Court and that the concerned Judge had already demitted office on account of superannuation on the date of the incident". There is therefore reasons to suspect that all was not well and the said woman might have made those charges because she did not get some expected help from the accused and that she had some reasons for visiting him even at night, etc.
 
All will be clear if the statements of the intern and the judge and the three affidavits of witnessses are made public. These will be given to the parties concerned, either one can release the documents. I am sure the press already has all the material. Only timing of release will be decided by the politicians.
