When rape is sacred

Most of us grew up watching movies about two kinds of women, who endured different kinds of suffering with different results. There was the haughty rich girl, who had to be ‘tamed’ by the impoverished, noble hero. Then, there was the sweet college girl who was all set to marry someone when she was – oops! – raped by an angry young man; she would then decide that she must retain her virtue by marrying her rapist, and would dedicate her life to reforming him, until he stopped beating her up, and bought her flowers one day.

We rolled our eyes at those movies. Well, most of us did, anyway.

It turns out they’re rather more progressive than our laws, which now have provisions for a woman to be compelled to live with her rapist – provided he starts raping her after marriage. So says Section 376 of the Indian Penal Code.

Worse, Section 375 basically allows for girls aged between 15 and 18 to get raped, as long as they are being raped by their husbands, though, technically, they are child brides and their marriages are illegal.

How do we get our heads around this anomaly?

It is an absolute disgrace that our legislators are quoting statistics of marital rape at each other, and yet failing to pass a law that protects women from marital rape.

It is considered that the concept of marital rape, as understood internationally, cannot be suitably applied in the Indian context due to various factors, including level of education, illiteracy, poverty, myriad social customs and values, religious beliefs, mindset of the society to treat marriage as a sacrament.

As seen in Hindi films, when chased by a rapist, heroines jump off buildings. This way, at the funeral, everyone can comment on the glow on the corpse’s face courtesy its continued virginity. Definitely death above rape until marriage, after which it changes to rape above death. If you cannot let a man touch you as a Miss, as a Mrs, you cannot tell him not to touch. A well-meaning society and a senile legal system will personally lock you in with your rapist and chuckle fondly when you cry.

Marital rape: A 20-year-old case could help wrest autonomy and dignity for Indian women

It is time to go back from 'marriage as a sacrament' to the long-ignored vision of gender equality.

The simmering controversy over the marital rape exception was stoked again on Wednesday, when responding to a written question in Rajya Sabha, the minister of state for home, Haribhai Parathibhai Chaudhary, said:

"It is considered that the concept of marital rape, as understood internationally, cannot be suitably applied in the Indian context due to various factors, including level of education, illiteracy, poverty, myriad social customs and values, religious beliefs, mindset of the society to treat the marriage as a sacrament."

The refusal to criminalise marital rape is not a partisan issue. In the aftermath of the December 2012 Delhi gangrape, the Justice Verma committee had recommended removing the marital rape exception as part of a package of criminal law reforms. However, this suggestion was rejected by the then-ruling United Progressive Alliance government.

Constitutionality

With the major parties seemingly unwilling to accept the proposition that non-consensual sexual intercourse within marriage should be treated as rape, the political battle is lost for now. Is it possible, however, to question the constitutionality of the marital rape exception? At first blush, it seems that the Exception to Section 375 of the Indian Penal Code, which states that “sexual intercourse by a man with his own wife, the wife not being under fifteen years of age, is not rape”, falls foul of at least two constitutional provisions.

The first is Article 14, which guarantees the equal protection of laws to all persons. The marital rape exception, however, denies to married women the protection of laws against rape, a protection that is extended to unmarried women. In other words, it unequally burdens a class of women solely on the basis of their marital status. And secondly, by depriving married women of an effective penal remedy against forced sexual intercourse, it violates their right to privacy and bodily integrity, aspects of the right to life and personal liberty under Article 21.

Such generalizations have to be universal, for them to be valid. And if we were to go by the above logic, we will realize that there may not be anything that could be deemed sacred.

Btw, the world is seeing a decline in the marriage market with more individual freedom being the emphasis. Does this mean that the reciprocating benefits between a man and a woman have diminisher?
