Shocked beyond words at this allegation! The Supreme court has been the only ray of hope so far! Hope its reputation is not tarnished! Pray that this does not turn out to be true!

[FONT=&quot]The Supreme Court has appointed a committee consisting of justices R M Lodha, H L Dattu and Ranjana P Desai, which will start work from this evening to look into the allegations of sexual harassment by a law student.

Chief Justice P Sathasivam says that, "As the head of the institution, I am also concerned about the allegation and anxious whether the statement is true or not. The committee will go into the whole affair and find out
the facts and prepare the report. We are taking steps and in cases of sexual harassment, we cannot take it lightly.

Stella James, a young lawyer, blogged last week that she was sexually assaulted while interning with a retired Supreme Court judge in December 2012.

This was the time of the Delhi gang-rape protests and she wrote, 'In the strange irony of situations that our world is replete with, the protests were the backdrop of my own experience.

"...I dodged police barricades and fatigue to go to the assistance of a highly reputed, recently retired Supreme Court judge whom I was working under during my penultimate semester.

"For my supposed diligence, I was rewarded with sexual assault (not physically injurious, but nevertheless violating) from a man old enough to be my grandfather.' [/FONT]
 
This is a little unsettling !

I cannot help but observe that the complaint is of such type that is rather vague and difficult to prove. To quote from her blog (Through my Looking Glass | JILS Blog)

Now that the SC has started its probe, probably the "gory" details would have to be detailed. I do not say this for the perverse pleasure of curiosity, but that this is, eventually, the detail that would decide the case, provided it is "proved".

While the incident affected me deeply, I felt little anger and almost no rancour towards the man; instead I was shocked and hurt that someone I respected so much would do something like this
but curiously thought to blog it out as her "experience" to ask one thing
So, I want to ask you to think of one thing alone – when dealing with sexual violence, can we allow ourselves to embrace feelings beyond or besides anger, and to accept the complexity of emotions that we face when dealing with any traumatic experience?

One legal practitioner told a channel tonight that he felt that the right thing for any court to do was to take cognisance of a criminal offence of sexual assault having been committed, to get a case registered suo motu against the accused and set in motion the proper police investigation.

This probe, committee etc., will be only for fooling the public, he said.

I don't know the legal minutiae. Those who are knowledgeable may give their views.

Welcome to the club.

This is nothing new...after all when we were in college many of us students also faced harassment by some senior professors who held our hands..touched our face during viva voce exams!

Who dare fight?? Cos we feared failing exams and just sat there through the exam answering questions when the professor was busy touching our faces/hand/hair etc.

You know how hard it is actually answering questions when you have to keep a watch on the creep to make sure he does not go too far?

Hate such smooth criminals.

So you see..such smooth criminals can be anywhere..from auto drivers to supreme court...Justice may be Blind but Testosterone is NOT!

BTW men arent the only smooth criminals.

In India when I was a student there was another college near by mine(Non Medical college) where one of the professor's wife took a liking to a very handsome male student whom she saw at a college function and she harassed him real badly..telling him she will make sure her husband fails him if he does not given in to her desires.

Poor guy actually cried and fell on her feet to leave him alone.

Dont know what happened cos she also told him that if he does not do as she says she will tell her husband that it is him(the student) who likes her!

That female was such a evil one..desperate for a young male student.

Victims of the church hid their ordeal for decades. The political and legal environment has to be right for getting justice. Else nothing will come out of such complaints. Longer delays also make proving and conviction more difficult.

It is a disturbing news. But if it is true, I am surprised why this Lady Lawyer has delayed for over 10 months to bring this alleged "sexual violation" for legal action. How ever it is good the SC has appointed a committee of Judges to go into the allegations..

Yes, if we look long enough and hard enough, we may find a woman sexual predator, but, there is simply no equivalency between the two genders when it comes to sexual crimes. Have you ever heard of an instance when an innocent boy was molested by girls during a bus ride, let alone gang raped by them.

So, please, I request you to refrain from gross false equivalencies.

What I understand from Ms. James' blog post and the above article is, her grievance is not a narrow one directed against one particular retired SC justice, it is about the pervasive attitude in the society towards unwelcome sexual conduct by men. There is understandable outrage when we hear of heinous crimes like the Delhi rape case and the public, as Ms. James puts it, "baying for the blood of “creepy” men."

But women are subjected to the danger of traumatic experience almost every time she steps out of her home. No three judge panel can even begin to address this social ill. This is the question Ms. James is raising now. IMO, she is more interested in protecting young girls and women from all the "creeps" who occupy positions of power, not just this one retired justice, whom she says she has forgiven which made her sad!

Let the three judge panel investigate the allegations, let them file a report, let them take some action, but that is going to amount to very little because this case is hardly unique.

I am not laughing Ha Ha Ha for nothing at all..that was a sarcastic laughter.

I have been in India where so called learned professors harassed female students and out of fear female students kept quiet.

At the age of 19 - 20..young female students are 1st time out on their own on college sometimes in a different country too..so you see such predator males in high position know to prey on whom.

Some males when they are in a high position, they get a sense of being in control and some hit a prolonged or extended mid life crisis coupled by andropause....have you ever noticed an electric bulb when its just going to blow out?
It suddenly becomes exceptionally bright before its fuse finally blows out isn't it?

So you see that is the same with end stage andropause...men in power want their last shot before they call it the quits and try for younger woman who are working or studying under them(pun not intended here)

So you see I dont simply write cock and bull and say Ha Ha Ha for nothing at all.

If you had been a female student and had a Professor touch your face and hands during exams then you will know that my Ha Ha Ha was sarcasm and not making fun of any situation.

BTW I added the story of the female predator cougar trying for a young male student just to highlight that anyone can be a predator..after all we believe in gender equality isnt it?

But this case is special. The lady is from a well off family, is well educated and has legal qualifications and training. She could have acted immediately after the alleged incident and sought remedy. Instead she is writing a blog on it with vague allegations. Anyway the media will scream and fill air time when nothing better is available. Yesterday only sachin filled the waves, Rao was totally ignored.

See how the media reported two incidents recently. A delhi woman committed suicide citing harassment by her college principal. Women's human right forum has cleared him after investigation. And in patna blast, one bomber died of injuries suffered when it prematurely exploded.

Press headings were:
1. Rapist principal exonerated.
2. Alleged bomber dies of injuries, in hospital.

Another interesting case is that of Dr. nambi narayanan, falsely implicated in spy scandal and imprisoned. Five CMs of kerala ditched him, only narendra modi helped him (nambi's own words).
 
The intern has named the judge!

The Supreme Court has revealed that the former judge accused of sexually harassing an intern in December is AK Ganguly. "I am totally innocent," he told NDTV, adding " I have worked with several interns in my life... a large number of them... I treat them like my children."

The former judge has testified for three serving Supreme Court judges who are investigating the charges. So has the young woman lawyer who complained against him in a blog earlier this month, without naming him. She said he harassed her in a hotel room in December. "I am totally shattered," the former judge told NDTV.

Justice Ganguly was on the bench which delivered a landmark verdict in February 2012, cancelling 122 licenses for mobile networks, on the grounds that they had been allocated without transparency.

The committee handling the inquiry against him submitted its report today to the Chief Justice of India, P Sathasivam.

Justice Ganguly, who retired earlier this year, is now the Chairman of the West Bengal Human Rights Commission.

"Please don't compare this with Tejpal's case, please" he said to NDTV.

The inquiry against justice Ganguly began just days before Tehelka founder Tarun Tejpal was accused of raping a younger female colleague. The cases have often been clubbed in a national debate on men in positions of power violating women in the workplace.

AK Ganguly has delivered several landmark judgments against the interests of the current political establishment including the famous cancelling of 2G licenses. Therefore some suggest this could be a political conspiracy. However, we must take into account that another intern has leveled similar charges against the same judge. Hope the truth comes out after proper investigation.

One point to note is that the judge has worked with this intern and others on various occasions in his home and in hotel rooms etc. Aren't there any work place regulations or at least recommendations against these types of work situations?!
