Dear Sir,

I have severe paranoid schizophrenia and am considered a disabled person across Singapore and Australia. I obtained a disability certificate from India. I have attached all three documents here.

But I am highly intelligent although severely disabled. I am called a high functioning individual according to Western medical science or HFI.

My Complaint..

During covid I was approached by the recruiters of caliber Interconnect in coimbatore for a Senior manager job with total yearly salary of 20 lakhs.

I joined the job in mid February 2021 during covid. Because I secured a high paying job, I was emboldened to close my pending loans by paying cash because the banks were causing problems.

This put severe financial stress on me. But I was happy I had a job and joined. But soon I noticed as a senior manager that the company was providing morning breakfast at 7am, lunch and dinner at 7.30pm free of cost. This made the employees work more than 12 hours a day. I complained to my managing director suresh that the job was in software and IT. It required mental work and was not like mechanical jobs of welding or fitting. Therefore I did not want my subordinates to develop mental health issues. He listened quietly and did not take action. A north Indian employee at that time had confided with me that he was from Bangalore branch of caliber and had been hospitalised because of overwork and the management shifted him from Bangalore to coimbatore where he does not know anyone and knows only hindi. As I knew hindi I was able to talk to him and find this.

Suddenly after two weeks the HR called me and asked me to resign. They said they did not want to fire me because I was a senior candidate. So I accepted and resigned. It was a big mistake
Now I know that if they had fired me I could have gone to court. They said they had received negative feedback but did not say what was the negative feedback or who gave it. Since I resigned now I cannot do anything. This is prevailing practice in IT industry. They ask you to resign and forget about you


When I asked for monies in lieu of my 3 months notice period. They stopped answering my emails and phone calls. My last half month salary for April 2021 as I resigned on 12th April was also not given. I was also not given an experience letter.

This created big problems for me. I had paid all the cash to close the loans as I depended on this job. Now no job, no last month pay, no notice period pay and it was covid. I literally cried myself to sleep.

I complained to the labour Commissioner in coimbatore in mid 2021. They also took no action. I complained to the chennai labour commissioner nothing happened. Then I complained to central labour commissioners they simply forwarded it back to coimbatore labour commissioners and nothing happened. Finally I complained to PM office not once but three times. I got one letter stating I resigned on April 3rd and all my dues were paid. But I emailed my resignation only in April 12th and HR replied only on noon April 12th that they are processing my resignation.

Now I contacted the RTI to find out what happened to my PM office complaint and they said replied that nobody received any complaint.

Now where should I go and complain and who should I complain against??

I am an average citizen and I don't know what to do. I also have registered a complaint regarding problem with issuance of medical disability certificate with the state commissioner office for Persons with Disabilities as on 24th and 26th October 2024 through email. When I came to your offices the person in the legal department is saying the word Dravidam and is of zero help and he asked asked to leave. Now a lady doctor who was on duty today on xx April 2025 is telling me this should have gone before the Commissioner court.

Please take action immediately and as necessary. All I want is the due from caliber Interconnect which comes to around 6 lakhs. I will put a fixed deposit and do something with the interest.

But as I am seeing that nothing is happening and the person in the legal department of your esteemed offices of state commissioner for person's with disabilities is talking about dravidam openly and asking me to leave. I have little hope.

I am preparing to go to supreme court under article 32 now. Therefore please preserve this documentation email as it will be produced in supreme court eventually.

Please do what you need to do as you see fit very quickly and to save yourself when you are asked to come to Delhi for hearing.

My lawyer is in BCC.

Its been three years since she passed away and I am still unable to cry.

I have nothing.. Absolutely Nothing

Seeing that I have nothing, my mothers side uncles came together and said that they will give me the small 200sqft portion in which my grandmother last lived. Initially, there was some discord but somehow all agreed and came to my father and brother so they could sign the documents (since they are also legal heirs since amma passed away). Appa shouted.. leave my family alone.

He hates my mothers side family like any proper brahmin maaplai of the 80s does. But the problem is he hates me too, I have posted a bit earlier but not in much depth regarding this problem. To touch on it lightly, he would never invite me to any event that is happening in his side of the family (Fathers side) so I am cut off from that family. And when it comes to mothers side family, he shouts and screams at everyone that they are afraid to talk to me. Like he shouted.. Leave my family alone when they came to write a small puny apartment in my name.

It so happened that my maternal uncles tried a round 2 but that was scuttled by my singaporean maternal aunt Sulo with a little help she managed to incarnate called baby. I was severely anguished by the turmoil caused for my uncles because of my purported claim to grandmothers place so I posted that my last cousin should be considered for being heir apparent since he was the son of my grandfathers son and the lineage will continue unobstructed. Even as I called for a vote to see who was thinking what, baby knowing the numbers quickly jumped into the chat and closed the subject saying.. "You are great Da. We accept your decision and the flat will go to.. yada yada.. We will always support you." Nope. I dont know what happened behind the scenes but there were 4 men and 2 women who had to vote and one man openly said that the flat should go to me and it was going to a vote when this happened. Yup. Sulo is the one in Singapore that I wrote about.. she blocked my phone and told everyone I blocked her. But only my uncles are all in line. Still trying to help me. But not knowing what to do.

So I am.. in all points of view.. all alone. With absolutely nothing to my name.

What a ride it has been ... from top 0.1 percent (in English LOL) in school and a house captain after standing in the school pupil leader elections to top 95% in GRE and TOEFL as well as a scholarship to the USA, followed by a research thesis that was published as book totally free of cost to me and a first job as a Project Leader in SFO Bay Area place called Livermore.

to now..

Nothing.. and No one around. Even mother is long gone.

The eldest uncle is still telling me.. Forget everything.. I will get you a PhD admission.. you can read and write. Get the degree and work as a professor in some college. I will try to find a bride for you. You can settle down even now.

I dont know what to do.. After all that happened and the fact that I am 45 now... and mentally ill.

This will mean that we just squirt into the Supreme Court premises without much delay and debate. Its only the top few lines that have to be changed for this to be a supreme court case but irritatingly.. it has to go through the High Court first.

PETITION UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA SEEKING REDRESSAL FOR VIOLATION OF FUNDAMENTAL RIGHTS UNDER ARTICLES 14, 15, 16, 21 AND FOR APPROPRIATE ACTION UNDER THE RIGHTS OF PERSONS WITH DISABILITIES ACT, 2016

TO, THE HON’BLE CHIEF JUSTICE AND HIS COMPANION JUSTICES OF THE HON’BLE HIGH COURT OF MADRAS

THE HUMBLE PETITION OF THE PETITIONER ABOVE NAMED

MOST RESPECTFULLY SHOWETH:

1. That the Petitioner, Mr. P V Krishnan, is a citizen of India, medically certified as suffering from Paranoid Schizophrenia with auditory hallucinations, with an 17-year medical history involving consistent psychiatric treatment and multiple hospitalizations. He is protected under the Rights of Persons with Disabilities Act, 2016 (RPwD Act).​
2. The Petitioner approached the Institute of Mental Health Outpatient Block, Kilpauk, Chennai, in August 2024 for the issuance of a disability certificate required to claim the 10-year age relaxation for persons with disabilities under applicable recruitment rules for a government post.​
3. Despite furnishing all medical records, the Chief Medical Officer (Respondent No. 2) willfully delayed the issuance of the certificate by imposing irrelevant psychological tests spanning over a month, and on 12th September 2024, further humiliated the Petitioner and his father who are also Brahmins in public by stating, "People like you will get pension and go. I cannot allow this." This discriminatory and casteist comment was followed by a referral to psychosocial intervention rather than the issuance of a certificate.​
4. Due to this deliberate delay and humiliation, the Petitioner could not apply for the government job for which he was eligible and missed the deadline. As of 1st January 2025, he crossed the maximum permissible age limit (45 years - 35 years Max Government age limit plus 10 years age relaxation for persons with disabilities), making him permanently ineligible for future government recruitment despite being entitled to age relaxation.​
5. On the advice of the petitioners physician, a threat of legal action was made in the first week of October 2024 following which a "Temporary" Disability Certificate was issued which was of no use because the last date for application to the relevant government post expired on September 15th 2024.​
   
   
6. It may be noted that ever since the identification of Schizophrenia as a severe chronic condition in the early 13th and 14th centuries, there was never a time when Schizophrenia was considered "Temporary". It was always categorised as a permanent disability which had no known medical cure.​
7. A formal complaint to the Tamil Nadu State Medical Council (Respondent No. 3) resulted in no meaningful action, with the grievance being merely forwarded to a subordinate office.​
8. A formal complaint to the Central and State Commisioners office for Persons with Disabilities as of October 24th 2024 was also met with no meaningful action.​
9. A formal complaint to the police stations in Kellys, Ice House and Ayanavaram led me into a wild goose chase with me walking from one police station to another. No complaint was filed in the end. An online police complaint HNP 24462423 also met with no meaningful action.​
10. This above point specific to Tamilnadu Police is only added to show the systemic malaise in Tamilnadu. In their pursuit to kill the average tamil man’s belief in God, the Dravidian Parties, Politicians are targetting the Brahmins and have made this brahmin hatred spread across the state by manipulating even 8th and 9th standard students to read glorification of their ideologies. Even the Tamilnadu Public Service Exam has syllabus which includes Dravidian Political Ideologies, the politicians and their achievements. This brain-washes the average tamil man even before he enters manhood and has a job – government or otherwise.​
11. Please do not initiate action on the average constrable, SI or Inspector. These people work hard for their daily food and clothing. But do think about the salary and other government subsidies for a Chief Medical Officer, the Tamilnadu State Medical Council and the overall wealth of the Stalin and his family. The lowest rung of the family – Kavya Maran has an IPL team – Sunrisers Hyderabad in her name. The average policeman does not have anything but his work ethics, kindly do not crucify them. I or my petition will not support any action against the Tamilnadu Police Force.​
12. In addition to the above, The Chief Ministers Office sent a letter addressed to P V Krishnan in support of the Chief Medical Officers actions and justifying those actions using a lie and incorrect / frivolous representation of the facts of what transpired(P V Krishnan was accused of not submitting medical certificates for the year 2023-24 and this made the decision to not issue a disability certificate correct. This inspite of the fact that past 17 years medical history from international medical institutions and doctors from Singapore, Australia and India being submitted along with the current medical prescriptions for the year 2023-24). Such an endorsement of the delay and denial of a disability certificate scared and scarred P V Krishnan permanently because of the Chief Minister of Tamilnadu himself being complicit and involved in the obvious caste based discrimination in issuance of a government disability certificate.​
13. Under the Bharatiya Nyaya Sanhita, 2023 (BNS):​

• Section 197 – Disobedience of Law by a Public Servant -- If a public servant knowingly disobeys a law intending to cause injury to any person. Punishment: Imprisonment up to 2 years and/or fine.​
• Section 198 – False or Malicious Order or Report by Public Servant -- Covers framing incorrect records or maliciously causing injury in judicial or administrative capacity. Punishment: Imprisonment up to 7 years and fine.
• Section 124 – Offence of Atrocity Against Scheduled Castes/Scheduled Tribes -- If a minister uses CASTE-BASED derogatory remarks or discriminatory action against a person from SC/ST, this may fall under this provision in addition to SC/ST Atrocities Act.

• Section 132 (1)(b) – Criminal Intimidation or Insult Against a Public Right -- If a public official insults, intimidates, or intentionally humiliates a person in a public setting. Punishment: Up to 3 years or fine, or both.

• Section 351 – Abuse of Authority or Power by Public Servant -- New provision specific to BNS. Covers abuse of lawful authority with intent to cause harm, delay, or personal gain. Punishment: Rigorous imprisonment up to 5 years and fine.

1. The Respondents have violated the following:​
   • Article 14 – Right to Equality​
   • Article 15 – Prohibition of discrimination on the basis of caste or disability​
   • Article 16 – Equal opportunity in public employment​
   • Article 21 – Right to Life and Dignity​
2. Under the Rights of Persons with Disabilities Act, 2016:​
   • Section 89: Contravention punishable with fine up to ₹10,000 for first offence and ₹50,000–₹5,00,000 for subsequent offences.​
   • Section 92(a-c): Discrimination or intentional insult punishable with imprisonment (6 months to 5 years) and fine.​
3. Under the Indian Penal Code:​
   • Section 166 IPC: Public servant disobeying law with intent to cause injury – up to 1 year imprisonment or fine.​
   • Section 219 IPC: Corrupt or malicious decision in a quasi-judicial capacity – up to 7 years imprisonment and fine.​
4. The actions and omissions of the Chief Minister of Tamilnadu as also Respondents 2 and 3 are not only a dereliction of public duty but also amount to willful violation of statutory and constitutional protections granted to persons with disabilities. The endorsement of such discriminatory actions by state-level authorities including the Chief Minister’s Office aggravates the abuse of government machinery.​
5. The Petitioner has no other alternative remedy but to approach this Hon’ble Court.​

PRAYER

In light of the above, the Petitioner respectfully prays that this Hon’ble Court may be pleased to:

a) Issue an appropriate writ or direction initiating disciplinary/criminal proceedings against the Chief Medical Officer on duty on September 12th 2024, IMH Outpatient Block Kilpauk, Chennai for violations under the RPwD Act, 2016 and relevant sections of the IPC; Just like he proclaimed... this particular Chief Medical Officer has now ensured that the petitioner will not get a government pension which would have ensured a comfortable life for the mentally disabled petitioner in his old age inspite of his medically incurable schizophrenia.This person should be publicly named, shamed and given the maximum jail sentence even if every other accused in this case escapes legal culpability. This person has kicked in the pit of the stomach of a helpless mentally disabled person and sought governmental support to hide behind political power.

b) Issue an appropriate writ or direction initiating disciplinary/criminal proceedings against the Chief Minister of Tamilnadu as of 2025 for his letter to the petitioner denying him a disability certificate, for violations under the RPwD Act, 2016 and relevant sections of the IPC; The Chief Minister of the State of Tamilnadu is the topmost authority of the State and he himself has waded into this blatant support for caste based discriminiation in the issuance of a Government Disability Certificate. This must not be left unchecked and Stalin should be held personally accountable as also issued a jail sentence as under Section 92 (a-c) for sending official State Government Documentation and abusing government machinery while elucidating his support for criminal behaviour against a mentally disabled person.

c) Issue an appropriate writ or direction initiating disciplinary/criminal proceedings against the State Medical Council of Tamil Nadu to take expeditious and punitive action against officials responsible for inaction and dereliction of duty; The Tamilnadu State Medical council did not flinch even a bit and take action (except forward my emails to a subordinate office) inspite of the fact that the petitioner clearly stated his intention to pursue this issue even into the Supreme Court in 2025.

d) Direct the State of Tamil Nadu and the Union of India to compensate the Petitioner adequately for the loss of opportunity and irreparable damage caused;

e) Direct the State of Tamil Nadu and the Union of India to immediately issue a Permanent Disability Certificate to the petitioner P V Krishnan.

f) Mandate systemic reforms in the issuance of disability certificates to avoid recurrence of such violations;

g) Pass such further orders as may be deemed just and proper.

AND FOR THIS ACT OF KINDNESS, THE PETITIONER SHALL, AS IN DUTY BOUND, EVER PRAY.
