Salman Khan hit-and-run case: Ravindra Patil a ‘wholly unreliable’ witness, says HC; verdict tomorrow

The Judge observed that the evidence of Patil was doubtful because he had made improvements in his version later when his statement was recorded.

The Bombay High Court on Wednesday doubted the evidence of Ravindra Patil, former police bodyguard of Bollywood star Salman Khan and witness in the 2002 hit-and-run case, observing that he was “wholly unreliable.”
Justice A R Joshi said this while dictating the verdict in the appeal filed by the actor against the five-year sentence awarded to him by a Mumbai sessions court on May 6 this year. The high court will pronounce its verdict in the case tomorrow.

Patil had lodged the FIR in this case on September 28, 2002, hours after the mishap occurred. In the FIR, he did not mention whether Salman was driving the car under the influence of liquor.

2002 hit-and-run case: Bombay high court acquits Salman Khan

The Bombay high court on Thursday acquitted Bollywood star Salman Khan of all charges in the 2002 hit-and-run case, quashing a trial court verdict that held him guilty of driving his Toyota Land Cruiser over people sleeping on a Bandra footpath.

Justice AR Joshi said the 49-year-old actor cannot be convicted because the “prosecution has failed to prove the charges against Khan on all counts”.

Chief minister Devendra Fadnavis said the Maharashtra government will decide on further course of action in the case after examining the HC verdict.

He directed the actor, who was present in the court with sister Alvira and manager Reshma, to furnish a fresh surety bond of Rs 25,000 and asked police to return his passport.

Salman had appealed against the sessions court’s May order that delivered a five-year jail sentence after convicting him of culpable homicide not amounting to murder for running over five people on a pavement, one of whom died later, in Bandra West on September 28, 2002.

On December 10, the Bombay High Court acquitted actor Salman Khan, 13 years after a man named Nurullah Sharif was killed in a hit and run incident.
While dismissing the prosecution's case, Judge AR Joshi also dismissed the statement given by Mumbai police constable Ravindra Patil, and said he cannot be considered a 'wholly reliable witness'. The Mumbai sessions court in May 2015, had convicted the actor of killing one person and injuring four others in the 2002 hit-and-run case.

At the time of the incident, Ravindra Patil was assigned to be Salman Khan's bodyguard, after the actor complained of threats from the underworld.

Accident victims indifferent to order, hope for funds from Salman

MUMBAI: For 26-year-old daily wage worker Firoz Shaikh, the night of September 28, 2002, changed his life forever. Son of the sole casualty Nurullah Sharif, Firoz, then barely into his teens, was forced to give up his studies, the only path open to all to improve their lives, after the accident involving actor Salman Khan.

"It changed the course of my life for the worse. I don't care if he is convicted or acquitted. It does not make any difference to my life. I will always pray that God bless him in every way," he said after Thursday's verdict.

Firoz says all he is concerned about now is receiving any kind of monetary help from the actor. "I am as good as an angootha chhaap (illiterate). If I get some compensation, I can educate my two sons and ensure they do not suffer the same fate as me," said Firoz.

Pointing out that the prosecution had failed to prove his guilt beyond reasonable doubt., the court noted that there were many loose ends and that the benefit of doubt had to be given to the accused. Now that's the law of the land, and there's no point questioning the judgement. It's up to the Maharashtra government whether it chooses to pursue the case further, but there are a lot of unanswered questions from this case.
