Supreme Court orders Nithyananda to undergo potency test

Nithyananda had approached the apex court to challenge a Karnataka High Court order that had directed him to undertake the medical test.
The bench headed Justice Ranjana Prakash Desai said there is no reason why a rape accused should not be undergo a potency test.





Why must a rapist be potent? I do not understand this requirement.
Even Bapu Asaram was subjected to this test, and he was proven potent.
A rapist who is not potent is still capable of raping with other tools, so what does this test prove.
Western countries do not require such test, and waste of time, why in India they do this?

There is no need for a potency test in rape cases.

I have examined rape accused before and not all can actually rise to the occasion when examined either out of fear or by sheer will power.

In cases of rape all that is wanted is semen sample and if the person cant produce a sample the doctor has to perform prostatic massage to elicit a sample.

Potency test at a much later date is of no medical significance becos at time of the alleged rape the person could have been potent and subsequently the person could have become impotent.

Medical records of Arathi Rao that were released by a US court a few years earlier showed her to be a carrier of the highly contagious STDs. This medical test found Nithyananda to be free of those incurable diseases, further bolstering his claim of innocence.

Nithyananda was accused in 2010 by a scandalous video that allegedly showed him in a compromising position with a popular actress. Both he and the actress have insisted that the video was morphed, a claim that was later proven by a confession by the COO of the media house that had released the fake video on YouTube.

Not in any particular reference to this case.

Absence of STD does not mean there was no rape.

Rapists are also known to use condoms.

Also even if a Condom was not used and the rapist contracted the STD from his victim..he could have also have taken treatment for it.

Gonorrhea for example is highly contagious and also highly treatable.

Males who had have Gonorrhoe recover within 1 week of treatment.

Males seek treatment for this becos the symptoms of Gonorrhea are very acute in a male.

In a female the symptoms of Gonorrhea can even go undetected before real damage is done.


Even in other STDs the titre of antibodies return to baseline after treatment.

But in case of Syphilis even though a person is treated and cured from it a tell tale TPHA test will show previous exposure to it.

So it all depends what STD Arti Rao had!

These are all western created hype because previously they lived aloof but because of our compulsions in life of what we want to get through some means, we believe all people who only speaks high values.Instead of this it is better, we keep all who renounced life in forest like in the olden days. This is only one of the known cases. Why should these things to be given more propaganda, I know...These are not only individual problems....These are all root cause of following very demanding money based life instead of value based life...As though only one person or whomever who is caught as the only culprit....Just like Jesus...if anybody asks to throw stone at the person who has not committed any sin ...no body will come forward
These are all some media hypes for sensational news to boost up their circulation and to visual media to increase their TRP rating...Instead of looking at the root causes, we are just groping in the dark and doing something, which is not going to end even if you give severe punishments to these type of cases.
