LIVE! India removes barricades outside US embassy, asks for salaries paid to Indian staff


Senior leaders like Rahul Gandhi, Sushilkumar Shinde and Narendra Modi have refused to meet a US Congress delegation. In fact, all ministers had been told boycott the US delegation.

Further, according to a tweet by NDTV's Nitin Gokhale, the Delhi Police will remove all barricades outside the US Embassy with immediate effect.

India has also asked for details of salaries paid to Indian employees.

After Khobragade was arrested and handcuffed in public in New York, she was also reportedly subjected to a humiliating strip search and was kept in a cell with drug addicts after her arrest for alleged visa fraud last week.
 
Timeline: trouble brewing since june. Indian embassy in US, indian govt. and US govt knew what was happening. Other side of the story.

November 2012:Richard arrived in the US and started to workfor Dr Khobragade on November 23, 2012.

March 2013:
Problems started with Richard, according to DrKhobragade's lawsuit against her in the Delhi high court. It said that Richardwanted to work outside on her off days, but she was told that it was illegalaccording to her visa status, and also because she had an official passport.

June 23:
Richard leftDR Khobragade's home to buy groceries, and did not return. Dr Khobragadeinformed the matter to the consulate general, who informed the concernedauthorities.

July 8:
Richardvisited an immigration attorney's firm in Manhattan, New York. A person presentthere told Rediff.com thenthat four individuals from the consulate soon arrived at the attorney's office.There were discussions, and reports indicated Richard demanded asum as her wages, and an ordinary Indian passport.Meanwhile, her husband and child in India were taken into custody,according to the witness. A scared Richard spoke with them, and refused toleave the attorney's office premises.The consulate officials remained outside. Later in the evening,the police were called and they took Richard away.The Indian government revoked Richard's official passport the sameday, which made her status illegal in the US.The Indian embassy in Washington, DC requested the US StateDepartment to locate Richard and return her to India.

September:
The Delhi high court issued an order to restrainRichard from instituting any action or proceedings against Dr Khobragade outsideIndia on the terms or conditions of her employment, according to a statementissued by the Indian embassy.
In his order on September 20,Justice Jayant Nath noted that any grievance about the terms of employment,salary or ill-treatment could only be adjudicated by an Indian court, sinceRichard and Dr Khobragade worked for the Government of India.The high court also issued notice to Richard's husband Philip inDelhi. The case is scheduled for hearing in February.Meanwhile, an arrest warrant was issued against Richard by themetropolitan magistrate of the south district court in New Delhi under Sections387, 420 and 120B of the Indian Penal Code, according to the Indian embassy.These are related to extortion, cheating and conspiracy.If Richard enters India, she will be arrested.Richard chose to remain in the US rather than return to India,where she would be arrested on arrival, and the US officials proceeded againstDr Khobragade.Highly placed sources said the fact that Richard left heremployment within six months of her arrival in the US seems suspicious.

In the last two years alone, two Indian consular officers to the US have been in the news on charges of fraud and mistreatment of employees. Khobragade’s name has already appeared in relation to the controversial Adarsh Cooperative Housing Society scam, yet she was chosen to represent India to an important international partner. Is the IFS so short-staffed that they need to appoint people with questionable backgrounds to important posts in other countries?


It is highly unlikely the MEA or Khobragade were unaware of US visa or labour laws. In effect, the diplomat knowingly and wilfully violated the laws of a foreign power, one is tempted to say, with the same hubris shown at home. It is well known that appointments to countries of significance like the US, Russia, or Great Britain are handpicked by the government due to their sensitivity and importance. The question arises, how has the UPA’s MEA dropped the ball so badly in the last few years? Why is South Block hiring people of dubious repute?


In international politics there is no right or wrong, only sovereignty and the power to defend it. That, however, should not be taken to mean it is a wise course of action for Delhi to send frauds to represent it in foreign capitals; it hurts the reputation of India and Indians to be represented by people who make the news for the wrong reasons. It certainly is not the way Delhi's much touted soft power operates.

Richard became handy and the issue was blown out of proportion. Either Richard or K has something which is quite sensitive and they have to be shown their place. That was achieved by US. If some secret project can go wrong, it will go wrong-so says Peter.

I am told that this Khobragade incident is a crude method to get the US capatain of a ship arrested in tuticorin with terrorists on board. George Bush was more nuanced when he beautifully twisted MMS' & SG's arms without even a fly knowing about it. The case then was reportedly MMS' daughter's drunken driving. BO seems to be cruder just as his appearance!

Since it is election time, this development will escalate in forms unknown at present. But I liked NaMo's attitude in refusing to meet the dirty US delegation, and my hats off to NaMo's patriotic spirit. He has shown himself to be a statesman, and not a mere politician.

USA is so rude and inhuman to the envoy because she is from a dalit family. And so arrogant and will not tender an apology. USA is antidalit.

In USA there are large number of illegal entrants especially from nearby countries like Mexico.
They provide cheap labour for USA residents.I wonder why the USA Govt is closing their eyes in respect of such people
and do not enforce their Laws on such people.
My personal opinion (after staying in USA for over 4 years)is that Indians are considered as 'Not disciplined" like Westerners.
This is also the view of Indians who landed in USA in 1960s and 1970s.
I am worried that a time may come when local people start hating Indians who have proved their merit and are very prosperous comparatively in USA.
Hope a movement like 'Siva Sena' in Maharastra does not start after a few years in this country.
 
Now the issue is clear: USA takes action because she is; indian government takes no action because she is. mayawati in action.

Any other government, say chinese or pakistan, would have arrested all female embassy staff.

However, with the government taking sweeping measures and a somewhat petulant stand on the issue, getting back at the US diplomats in India quite vengefully, most of the parties in the Opposition didn't have much to chew on. However, trust BSP's Mayawati to find ways to give the issue a local political spin. As she declared in the RS that the government was hesitant in acting on the issue promptly because the woman was a Dalit and did not belong to a higher caste, she reduced what is an important foreign policy challenge to a vote-grabbing plank that might work wonders among her electorate.

In today's paper"The Times of India",a news item has come disclosing how the USA Govt gave T category visa to the Husband and two children of the maid and the husband with the Children
left India for USA on Air India Flight just two days before the arrest of Indian embassy officer.
The action of USA in this case raises suspicion and they want to have some hidden agenda to be carried out giving bad name to INDIA.It is also reported in the newspaper that the Father in law of the maid was working in US embassy,Newdelhi
and Mother-in law of the maid working as domestic help in the house of a USA diplomat in New Delhi.
Hope religion is not playing any role in this affair.
The Indian Diplomat is reported to have received a telephone call from an anonymous person to settle the case amicably with the maid,pror to her arrest.
Though the USA Government acted with their interests in view,the common man i.e USA nationals in USA is very courteous in their behaviour.
Now that the Secretary of State Mr.John Kerry has called Mr.Menon,National Security Advisor,Govt of India and expressed regret,the case will be sorted out amicably between the two countries.

The Govt of India has to learn some lessons from this incident.
It is not clear as to why some benefits(not extended to Indian Consul Staff in USA) was extended to the USA Consul Staff working in India in the first instance and then the facility is withdrwan after this incident
which was viewed by the Press in USA as' revenge action'.
In the letters to to the national newspaper" The Hindu", Mr.Itty Varghese,Kottayam has commented as follows:-
"True Reciprocity is justified and may even be recommended in diplomacy,but it is better that it is tempered with studied and mature restraint,especially when one deals with a powerful country that is 'friendly'
or make a pretense of it.
Another writer Mr.Ramabhadran Narayan from Coimbatore has cautioned the Govt of India to be careful in dealing with a big power like USA.
He has stayed in USA for more than 20 years.Considering the cost of living in New York the salary of Indian consular staff in USA is a meagre amount and he knows how much an ordinary individual needs to make to ensure one has a decent life.The Indian Govt is partly responsible for what has happenned and suggests that the Prime Minister of India confer with President Obama and resolve the issue at the earliest.
According to him what is at stake now is countless issues over which USA can arm twist India.
Mr.G.Parameshwaran from Coimbatore has raised a real picture.
"Countries in the West will never be our warm and fuzzy friends.What these Nations want from India is the best technical expertise in various fields and open market for their products.
Our relationship with them will be mostly economic in nature and no more.
We would do well to understand this and frame our policies and practises based on this 'real politik',rather than on some imagined and exaggerated sense of self importance".
Hope Govt of India takes into account the sentiments of general public while formulating their foreign policy after this incident.

India on Thursday hit back at U.S. Attorney Preet Bharara, who had justified Indian diplomat Devyani Khobragade’s arrest, accusing him of interfering with the Indian legal system and asserting that the arrest was not in keeping with the Vienna Convention on diplomatic immunity.
Criticising the U.S. Prosecutor for making statement for “post facto rationalization” for an action that should never have taken place in the first instance, External Affairs Ministry Spokesperson said there were no courtesies extended to Khobragade, who is the only “victim” in this case.
He said despite acknowledging that legal process were in place in India, the statement talks why it was necessary to evacuate the family of absconding maid Sangeeta Richard, thereby, making “implicit comment” about the Indian legal system, its enforcement authorities, and the responsibility that legal officials of a foreign government seem to “arrogate upon” themselves with regard to nationals of another country.
“We need to keep in mind the simple fact that there is only one victim in this case. That victim is Devyani Khobragade -- a serving Indian diplomat on mission in the United States.
“The action taken against her was not in keeping with the Vienna Convention. There were no courtesies in the treatment that was meted out to the diplomat, under the normal definition of that word in English language,” he said.
