An Ordinance to protect convicted MPs and MLAs from facing immediate disqualification was approved on Tuesday by the Union Cabinet, in effect negating an order of the Supreme Court.


The government decision to take the Ordinance route came against the backdrop of a Congress MP Rashid Masood facing the prospect of disqualification as he was recently convicted in a case of corruption and other offences.


The Supreme court on July 10 had ruled that an MP or an MLA would stand disqualified immediately if convicted by a court for crimes with punishment of two years or more. To negate the Supreme Court order, the government moved to amend the law and brought the Representation of the People (Second Amendment) Bill, 2013 in Rajya Sabha during the last session. However, the bill could not be passed.


Once the quantum of punishment is pronounced by a CBI court next month, Masood faces the prospects of losing his membership of Rajya Sabha as per the apex court order.

Looks funny that the ruling party introduces the emergency ordinance (mainly to protect Lalu Yadav for whom the verdict in Fodder scam is coming on 30 Sep), sends it to President ...Entire opposition cried hoarse & almost made the Presiodent toe their lines...With so much opposition to the ordinance, now suddenly the crown prince (Rahul) comes to the Press club & says it is a non sense ordinance...Look at the drama being enacted on public money ..

Unexceptionable as this was, it came not from an Opposition rabble-rouser, but from the son of Sonia Gandhi. If Rahul’s intention in lambasting his own government — which he said had “wrongly” cleared the ordinance — was to play the outsider, he has done it once too often. He cannot be both Congress vice-president and a rebel with unlimited licence to attack. If he thought the ordinance was “nonsense,” he should have spoken his mind at the outset, while it was still in the form of a bill in the Rajya Sabha. And the most effective forum for him to air his dissent would have been a party meeting and not a media conference. Intervention at that stage would have likely stopped the ordinance, whose objective has been questioned by the President, much to the government’s discomfiture. The true mark of a leader is his capacity to speak his mind at the right time and place — and speak it knowing the consequences. In the event, Rahul has left a mess in his wake. He has bypassed protocol and mocked at the “party line”, which from anyone else would have been treated as sacrilege. Worse, he has deeply embarrassed the Prime Minister, who was forced to take time out of his Washington visit to issue a statement indicating a rethink on the ordinance out of deference to Rahul. If the Congress vice-president’s outburst was meant to show he’s the boss, he could have accomplished the mission with greater grace.

I have nothing but the greatest admiration for the manner in which you are providing leadership in extremely difficult circumstances. I hope you will understand the strength of my own conviction about this very controversial issue.”


Evidently, Mr. Gandhi has been told that undermining the Prime Minister, who has for nine years led the UPA government, cannot help the Congress. After all, it is the record of this government that the party will have to defend in the run-up to the elections.
